1. General

1.1 The provider of the offer to create a “DUKKANIE customer account” and the associated services is DUKKANIE, Berliner Pl. 4, 23730 Neustadt in Holstein (hereinafter “DUKKANIE”), Managing Director: Raed Al Kherait (District Court 01055040 , VAT ID no. DE330504575). 

1.2 These terms of use exclusively regulate the offer and the conclusion of a contract for the creation and use of a DUKKANIE customer account. This service is referred to below and on our website as the “DUKKANIE customer account”.

1.3 By means of the DUKKANIE customer account, a customer can access various functions within the scope of using the other services of DUKKANIE and of the third parties connected to the DUKKANIE.COM website and / or the DUKKANIE app (hereinafter the “DUKKANIE app”), namely DUKKANIE -Customers, have recourse (e.g. overview of the order history, data management under “My Account” etc.). To use the other services of DUKKANIE or the DUKKANIE merchants (e.g. “pick-up service” and “delivery service”), you need to register and use a DUKKANIE customer account, i.e. a customer cannot reserve or order as a guest.

1.4 The use of other DUKKANIE services is subject to the DUKKANIE General Terms and Conditions or the General Terms and Conditions of the DUKKANIE merchants selected on DUKKANIE.COM.

1.5 The “DUKKANIE customer account” service is aimed exclusively at persons with unlimited legal capacity and legal entities. Persons with limited or no legal capacity are only authorized to use this offer with the cooperation and consent of their legal representative.

1.6 You can only create one DUKKANIE customer account in your name. Multiple registrations by the same natural or legal person are not permitted and can lead to a change or cancellation of an order subsequently made by you.

1.7 You are obliged to provide truthful information when registering or managing the DUKKANIE customer account and to change any subsequent changes that were requested during registration or account management or that you specified the next time you use it.

1.8 DUKKANIE makes it clear that visitors to the website or users of the DUKKANIE app are not entitled to create a DUKKANIE customer account.

 

Create a DUKKANIE customer account

2.1 The registration of a DUKKANIE customer account is required for the order of a further service (e.g. “delivery service”) or the use of individual services connected to the customer account. Here we need the following personal data from you for registration:

  • Title Mr. Mrs)
  • First name
  • Surname
  • E-mail address
  • Password for “My Account”

2.2 After selecting the password, in accordance with the password requirements above, you must confirm the password again in order to complete the registration (by clicking on “Register and continue”).

 

  1. First log-in and administration of the DUKKANIE customer account

3.1 After you have created your DUKKANIE customer account, you can log into DUKKANIE.COM or the DUKKANIE app for the first time by entering your stored email address and the password you have chosen.

3.2 You are obliged to keep your log-in data (especially your password) confidential. You are also obliged to notify DUKKANIE immediately of any unauthorized use of your DUKKANIE customer account and any other violation of the security regulations. The use of your DUKKANIE customer account by third parties is not permitted.

3.3 You can now decide whether you want to store further information in your DUKKANIE customer account or whether you want to change the data already given when you registered (e.g. under “My data”). These include

  • Optional specification of a telephone number (if we should prefer to contact you via this channel if you have any questions)
  • Optional specification of a billing address

 

  1. Functions of the DUKKANIE customer account

4.1 General

The DUKKANIE customer account offers you a variety of functions, including

  • Management of your data stored with us (such as your addresses)
  • Administration of your payment data stored with us
  • View past and current orders
  • Booking and administration of a delivery flat rate
  • Deposit of voucher / coupon codes
  • Collecting and redeeming digital loyalty points using the DUKKANIE app.

4.2 Digital loyalty points

4.2.1 You have the opportunity to collect so-called “digital loyalty points” when shopping in participating markets in the DUKKANIE app as part of a loyalty point campaign and to purchase loyalty bonuses at a reduced rate from a threshold defined in the respective loyalty point campaign (“bonuses”) ). To do this, you have to select the participating market in which you want to shop and collect or redeem digital loyalty points in the DUKKANIE app.

4.2.2 Within the respective loyalty point campaign conditions it is determined

  • How many digital loyalty points are required for the acquisition of one or more awards and what price is to be paid for these when acquiring the respective award,
  • How long the collected digital loyalty points are used to acquire rewards, i.e. can be redeemed (“redemption time”).

 

  1. Deletion of the DUKKANIE customer account

To delete your DUKKANIE customer account, log in as usual and go to the “My Account” tab and select the “Delete Account” sub-item. Please note: if you delete your customer account and all associated data, this cannot be undone.

Please note that we cannot execute deletion requests through telephone inquiries or inquiries from other e-mail addresses due to a lack of sufficient verification.

 

  1. Privacy

We will inform you about the handling of the data provided to us when using the DUKKANIE customer account in our data protection information.

 

  1. Limitation of Liability

7.1 DUKKANIE has unlimited liability for damage to life, limb or health that is based on a breach of duty by a legal representative or vicarious agent of DUKKANIE.

7.2 DUKKANIE has unlimited liability for other liability claims only in the event of intent and gross negligence on the part of its legal representatives, executive employees and vicarious agents.

7.3 DUKKANIE is not liable for simple negligence on the part of its legal representatives, executive employees and vicarious agents, unless an obligation is violated, compliance with which is of particular importance for achieving the purpose of the contract (cardinal obligation). Cardinal obligations are those obligations, the fulfilment of which enables the proper execution of the contract, the violation of which endangers the achievement of the purpose of the contract and which the other contracting party regularly relies on compliance. In the event of a negligent breach of a cardinal obligation, liability is limited to the foreseeable damage typical of the contract.

7.4 Liability under the Product Liability Act remains.

 

  1. Applicable Law; Place of jurisdiction

8.1 Applicability of German law: German law applies exclusively to all disputes that arise in connection with the use of the DUKKANIE customer account, excluding the EC sales law.

8.2 If the customer is a businessman, a legal person under public law or a special fund under public law, our place of business is agreed as the exclusive place of jurisdiction for all claims arising from or on the basis of this contract. The same applies to persons who do not have a general place of jurisdiction in Germany or persons who have moved their domicile or habitual abode outside of Germany after the conclusion of the contract or whose domicile or habitual abode is not known at the time the action is brought.

  1. Adaptation of the terms of use

DUKKANIE reserves the right to change these terms of use at any time at its own discretion and without giving reasons. You will be notified of the changed conditions at least six weeks before they come into effect. If you do not object within six weeks of being notified, the changed terms of use are deemed to have been accepted. If you object to the terms of use in due time, these will not become the legal basis for using the DUKKANIE customer account. DUKKANIE then has the option of terminating your use of the DUKKANIE customer account, taking into account a reasonable period of notice.

  1. Consumer arbitration

We hereby inform you that DUKKANIE does not take part in a dispute settlement procedure of a consumer arbitration board and is not obliged to do so. ”
